What is TDUP?
TDUP is proof of registration that must be owned by companies whose business activities are related to the tourism sector. For example, travel services, accommodation, tour services, and others.
According to article 1 point 7 of Minister of Tourism Regulation 10/2018, TDUP is a permit issued by the OSS institution after the business actor has registered business activities, carried out commercial activities by fulfilling the requirements and/or commitments.
Legal basis
The government regulations governing this matter are:
- Law number 10 of 2009 concerning Tourism
- Regulation of the Minister of Culture and Tourism No.PM.85/HK.501/MKP/2010 concerning Procedures for Registration of Tour and Travel Service Businesses.
Tourism Business Classification
The obligation for tourism business actors to register their business is regulated in Article 15 of Law Number 10 of 2009 concerning Tourism Businesses.
Apart from that, Article 4 of the Minister of Tourism Regulation Number 18 of 2016. Where the Law also explains the classification of tourism businesses, namely:
- Tourist attraction
- Tourism area
- Transportation services
- Tourist travel services
- Food and beverage services
- Provision of accommodation
- Organizing Entertainment and Recreation activities
- Organizing meetings, Incentive Travel, conferences and Exhibitions
- Tourism information services
- Tourism consultant services
- Tour guide services
- Water tourism
- Spa
Commitments that need to be met for TDUP?
A business permit in the form of a TDUP must be owned by business actors who have obtained an NIB (Article 8 paragraph (1) Minister of Tourism Regulation 10/2018).
The commitment referred to is a statement by business actors to fulfill (Article 12 paragraph (2) Minister of Tourism Regulation 10/2018):
- Location permission
- Environmental permit
- Building Construction Permit (IMB);
- Water Location Permit and Water Management Permit regulated by the Minister of Maritime Affairs and Fisheries (specifically for tourism businesses that use marine space permanently).
Requirements for obtaining TDUP?
- Notarial Deed and Ministry of Law and Human Rights Decree
- KTP and NPWP of all directors and shareholders
- Location permission
- Photocopy of Technical Permit
- IMB
- SPPL
- SKT KPP (Tax Service Office Registered Certificate)
- Neighbor approval (left, right, front, back) and household ID card (left, right, front, back)
- Environmental Permit (UKL/UPL or AMDAL), except for businesses located in areas that already have environmental permits.
Procedure for TDUP application?
- Applicant Registers at OSS (oss.go.id)
- Expressing commitment to completing the permit requirements, namely: Location Permit, Environmental Permit, IMB and other Business Permit requirements
- OSS issues business permits
- Receive notification from OSS that the business permit has been activated after the business actor fulfills the commitment.
- The TDUP business permit documents received are in the form of Electronic Documents
