The Affirmation on Immigration Services for Foreign Nationals – Based on the Director General of Immigration Affirmation Circular Letter Number: IMI-GR.01.01-3558 and with regard to the dynamics occurring in the community, hereby conveyed the affirmation of the Director General of Immigration Circular Letter Number: IMI-GR.01.01-1102 of 2020 Regarding Immigration Stay Permit Services In the New Normal Order are the following:

1. Return of ITKT Holder Status (Forced Stay Permit)

Return of ITKT Holder (Forced Stay Permit)

a) Number 5 letter d number 1) letter a)Foreigners who hold ITK (visitation stay permit) who have obtained ITKT (forced stay permit), can extend their stay based on the previous ITK during the Covid-19 pandemic period has not ended and there is no transportation to leave Indonesia.

b) Foreigners who hold ITK (visitation stay permit) as referred in letter a, include ITK Holders who are from multiple visit visa (VKBP D212) and foreigners holding APEC Business Travel Card (ABTC), with a validity period of each extension for 30 days.

c) Foreigners who hold ITK (visitation stay permit) and VKBP (multiple visit visa) D212 who have extended their stay permit can apply for transfer to ITAS status after fulfilling the requirements in accordance with the regulations.

d) Foreigners who hold ITAS (limited stay permit) and ITAP (permanent stay permit) as referred to in number 5 letter d number 2) letter c) and Number 5 letter d number 3) letter b) who have completed their stay permit, can apply for Visit Visa Telex or Limited Stay Visa Telex through the Online Visa Application at the Visa Sub-Directorate, Immigration Traffic Directorate, Directorate General of Immigration after fulfilling the requirements in accordance with the regulations.

e) Foreigners who already have a visa telex as referred in letter d can apply for ITK (visitation stay permit) or ITAS (limited stay permit) after paying PNBP Visa fees to the local Immigration Office without leaving Indonesia and without applying for a visa to an Indonesian representative abroad.

f) Foreigners as referred in letter d who will return to their country of origin or leave Indonesian territory for any reason may leave Indonesian territory within 30 days after the issuance of the Affirmation Circular Letter.

2. BVK Holders (Visa-free Visit and Crew Visit)

BVK Holders (Visa-free Visit and Crew Visit)

a) Number 5 letter fForeigners who hold BVK (visa-free visit) who have obtained ITKT (forced stay permit) must leave the territory of Indonesia within 30 days from the issuance of the Affirmation Circular Letter.

b) Foreigners who hold a BVK (visa-free visit) as referred in letter a and Crew Visit holders can apply for a Visit Visa or Limited Stay Visa Telex through the Visa Online application at the Visa Sub-Directorate, Immigration Traffic Directorate, Directorate General of Immigration after fulfilling the requirements in accordance with the regulations.

c) Foreigners who already have a visa telex as referred in letter b can apply for ITK (visitation stay permit) or ITAS (limited stay permit) after paying PNBP Visa fees to the local Immigration Office without leaving Indonesia and without applying for a visa to an Indonesian representative abroad.

d) Visa fees as referred in letter c are paid using the PNBP Visa type of service by first making a Billing Simponi as the basis for payment.

e) Proof of payment of Visa PNBP as referred in letter d is considered as Proof of Obtaining a Visa.

f) The passport of visit visa telex holders is affixed with the “Visit Stay” stamp.

g) The passport of limited stay visa telex holders is affixed with the “Limited Stay & Re-Entry” stamp as proof of granting/extension of a limited stay permit as well as a Re-Entry Permit.

3. Foreigners Who Have Visa Telex and Currently in Indonesia

Foreigners who have had a visa telex since December 1, 2019, who are in Indonesian territory can apply for ITK and ITAS after paying PNBP Visa fees to the local Immigration Office without leaving Indonesia and without applying for a visa to an Indonesian representative abroad.

4. Stay Permit Calculation

a) Foreigners who have had a visa telex since December 1, 2019, until the issuance of this Affirmation Circular Letter, the issuance of the Stay Permit is on the date the foreigner submits an application for ITK (visitation stay permit) and ITAS (limited stay permit) at the Immigration Office;

b) Foreigners who have a visa telex issued after the issuance of this Affirmation Circular Letter, the issuance of the Stay Permit is in accordance with the issuance date of the visa telex.

1. Immigration

a) Extension of VOA (Visa On Arrival), ITK (Visit Visa), Kitas / Itas, Itap / Kitap and Multiple Exit Entry-Exit Entry (MERP) already can be processed;
b) Foreigner address and passport mutations can be processed;
c) EPO and ERP (Exit Permit) already can be processed;
d) SKIM (Immigration Certificate) already can be processed;
e) An affidavit, children with dual citizenship already can be processed;
f) The transfer of ITK, ITAS, and ITAP status already can be processed;
g) Transfer of sponsors/guarantors already can be processed;
h) The Telex/Visa Approval application service has been reopened but specifically for foreign nationals who are still in Indonesia who can apply for Telex, visa processes and residence permit processes without having to leave Indonesia and without taking a visa at an Indonesian representative abroad. For foreign nationals residing abroad, visa application services have not yet been opened (cannot apply, until further notice);
i) Visa holders such as the visas index D212, B211A, B211B, B211C, and B213/Work Visa index 312/Investor Visa index 313 and 314 or ABTC (APEC Business Travel Card) which are still abroad, still cannot enter Indonesian territory. (Except, for the 7 exceptions listed in the Minister of Law and Human Rights Regulation No. 11 of 2020 and which already has a recommendation from BKPM, for PT PMA who will plan to bring in Expert TKA or company representatives during in the Covid-19 pandemic period);
j) Holders of Telex/Visa Approval still cannot obtain a visa at the Embassy/Consulate. The Embassy/Consulate only serves foreigners working on national strategic projects (in accordance with Minister of Law and Human Rights Regulation No. 11 of 2020 and who already have a recommendation from BKPM, for PT PMA who will plan to bring in TKA Experts or representatives companies in the Covid-19 pandemic period), but to make sure again, regarding embassies that have opened services, please coordinate with the embassy or consulate concerned to avoid mistakes in providing information;

2. Ministry of Manpower

a) Application for a new work permit cannot be processed based on a circular from the Ministry of Manpower No. M/4/HK.04/IV/2020 and Ministry of Law and Human Rights Regulation No. 11 of 2020 concerning Prohibition of Entry Into (Travel Prohibition) to Indonesia for Foreigners in response to the Covid-19 Outbreak. Except those who have a Recommendation Letter from BKPM. (Foreign Companies (PMA) who plan to bring representatives of foreign companies and experts (TKA) outside the Minister of Law and Human Rights Regulation No. 11 of 2020).
b) The Ministry of Manpower has reopened the extension of work permit services for foreign workers who will extend their Limited Stay Permits.

What about telex that is in the process, but was delayed due to the COVID-19 pandemic, is it already able to proceed?

Regarding this matter, it still cannot be continued related to the Ministry of Law and Human Rights Regulation No. 11 of 2020, but the Directorate said that it would be continued if the pandemic had ended and the service had opened again.

Are there other alternatives to continue the delayed telex?

No, all telex that is in the process during the pandemic is temporarily suspended until further notice except those stated in Permenkumham Regulation No. 11 of 2020 is specifically for those who work on the National Strategic Project.

Is the new application for foreign workers already opened?

Regarding submission for new applicants, according to Permenkumham No. 11/2020 and Circular of Minister of Manpower No. M/4/HK.04/IV/2020, new TKA applications are temporarily suspended, except for the work on the National Strategic Project in accordance with Presidential Decree No. 56/2018. For companies that want to bring in new foreign workers beyond what is intended by Article 6 of Permenkumham 11/2020 can still be submitted as long as there is a recommendation letter or information from BKPM.

What about the validity period of telex and visas that have been issued but cannot be used to go to Indonesia because of this pandemic?
  • The Indonesian Directorate General of Immigration has issued a new announcement regarding the Telex / Visa Approval. Foreigners who have obtained a Telex / Visa Approval or have already taken a visa/vitas at a Representative of the Republic of Indonesia abroad but have expired due to travel restrictions or no transportation that causes unable to travel to Indonesia, hereby informed: 1. Extension of visa approval validity period (telex visa); 2. Extension of the visa validity period.
  • Automatic extension of validity period for all approvals/telexes and visas issued since January 1, 2020, and have not taken a visa at the Republic of Indonesia representative;
  • Telex/visa approval has been extended for 60 (sixty) days after the COVID-19 Pandemic has been declared terminated by the relevant government agency;
  • Unused visas have been extended for 90 (ninety) days after the COVID-19 Pandemic was declared completed by the relevant government agency.

    If my ITAP is still valid but my MERP has expired can I still enter Indonesia & apply for new MERP at that time?
