Immigration Updates on Services for Foreign Nationals – Based on a circular from the Director General of Immigration number IMI-GR.01.01-1102 in 2020, Indonesian immigration has issued a new announcement about immigration residence permit services in the new normal order. Reopened services for foreign nationals include:
1. Returns of ITAS (Limited Stay Permit) and ITAP (Permanent Stay Permit) holders which have expired
a. Foreigners ITAS/Kitas (Limited Stay Permit), ITAP/Kitap (Permanent Stay Permit) or IMK/MERP (Multiple Exit Re-entry Permit) holder which expires and are still abroad that already have an approval letter from the Ministry/Relevant Agencies/boards and those who apply to Family reunion, to immediately re-enter Indonesia to extend the Stay Permit at the Immigration Office, within 60 days since the issuance of this circular.
b. Foreigners who do not meet the provisions referred to in letter (a) who will re-enter Indonesian territory are required to apply for a new visa in accordance with statutory provisions.
2. Extensions of ITK (Visit Visa Stay Permit), ITAS/Kitas (Limited Stay Permit) and ITAP/Kitap (Permanent Stay Permit) which are still valid
Foreigners who are ITK (Visit Visa Stay Permit), ITAS/Kitas (Limited Stay Permit) and ITAP/Kitap (Permanent Stay Permit) holders which is still valid and being in Indonesia can apply for an extension of residence permit at the immigration office in accordance with statutory regulation provisions.
3. Returns ITKT (Emergency Stay Permit) status holder
a. ITK (Visit Visa Stay Permit) Holders
i. ITK (Visit Visa Stay Permit) who has obtained ITKT/Izin Tinggal Keadaan Terpaksa (Emergency Stay Permit) holders can extend their residence permit based on ITK (Visit Visa Stay Permit) previously during the period of pandemic covid-19 has not ended yet and there is no means of transportation to leave territory of Indonesia.
ii. Foreigners who have extended ITK as referred to in letter (i) can apply for the conversion of status to ITAS/Kitas (Limited Stay Permit) in accordance with statutory regulation provisions.
iii. Extension as referred to in letter (i) must be made within 30 days since the date of issuance of this circular.
iv. Foreigners who do not meet the provisions referred to in letter (i), (ii) and (iii) will be subject to Immigration Administrative Measures in accordance with the statutory regulation provision.
b. ITAS/KITAS (Limited Stay Permit) Holders
i. Foreign ITAS/Kitas (Limited Stay Permit) holders who have obtained ITKT/Izin Tinggal Keadaan Terpaksa-(Emergency Stay Permit) can submit for extension of Stay Permit based on previous ITAS in accordance with statutory regulation provisions.
ii. Foreigners who have extended ITAS/Kitas (Limited Stay Permit) as referred to in letter (i) can apply for the conversion of status to ITAP/Kitap (Permanent Stay Permit) in accordance with statutory regulation provisions.
iii. Foreigners ITAS/Kitas (Limited Stay Permit) holders who have obtained ITKT and cannot be extended in accordance with applicable regulations, must leave Indonesian territory within 30 days from the issuance of this circular.
iv. Foreigners who do not meet the provisions referred to in letter (iii) will be subject to Immigration Administrative Measures in accordance with the statutory regulation provision.
c. ITAP/KITAP (Permanent Stay Permit) Holders
i. Foreign ITAP/Kitap (Permanent Stay Permit) holders who have obtained ITKT/Izin Tinggal Keadaan Terpaksa-(Emergency Stay Permit) can submit for extension of Stay Permit based on previous ITAP in accordance with statutory regulation provision.
ii. Foreigners ITAP/Kitap (Permanent Stay Permit) holders who have obtained ITKT and cannot be extended in accordance with applicable regulations, must leave Indonesian territory within 30 days from the issuance of this circular.
iii. Foreigners who do not meet the provisions referred to in letter (ii) will be subject to Immigration Administrative Measures in accordance with the statutory regulation provision.
d. VKSK/VOA (Visa On Arrival) Holders
i. Foreigners VKSK/VOA (Visa on Arrival) holders who have obtained ITKT/Izin Tinggal Keadaan Terpaksa-(Emergency Stay Permit) can extend their residence permit based on VKSK/VOA (Visa on Arrival) previously during the period of pandemic covid-19 has not ended yet and there is no means of transportation to leave territory of Indonesia.
ii. The extension referred to in letter (i) must be made within 30 days from the issuance of this circular.
iii. Foreigners who do not meet the provisions referred to in point a and b) will be subject to Immigration Administrative Measures in accordance with the statutory regulation provision.
e. BVK/Free Visa/Bebas Visa/Exemption Visa Holders
i. Foreigners BVK/Free Visa/Bebas Visa/Exemption Visa holders who have obtained ITKT/Izin Tinggal Keadaan Terpaksa-(Emergency Stay Permit) must leave the territory of Indonesia within 30 days since the issuance of this circular.
ii. Foreigners who do not meet the conditions referred to above, will be subject to Immigration Administrative Measures in accordance with the statutory regulation provision.
4. Holders ITK (Visit Visa Stay Permit) and ITAS/KITAS (Limited Stay Permit) who already have a Visa Approval/Telex and Notification
a. Foreigners ITK and ITAS holders who already have a Visa Approval/Telex Visa, who are in the territory of Indonesia can apply for the provision of ITK and ITAS to the local immigration office without leaving Indonesia and without applying for a visa to an Indonesian representative abroad.
b. ITK and ITAS as referred to in letter (a) are given after paying non-tax revenue/Penerimaan Negara Bukan Pajak (PNBP) visa fees at the local Immigration Office according to Indonesian Government Regulation No. 28 of 2019 concerning Types and Rates of Non-Tax State Revenues /Penerimaan Negara Bukan Pajak (PNBP), Applicable to the Indonesian Ministry of Law and Human Rights.
c. Visa fees as referred to in letter (b) are paid for using the VKSK and VITAS services on Arrival by first making a Billing Simponi as the basis for payment.
d. Proof of payment of VKSK and VITAS PNBP Upon Arrival as referred to in point (c) is considered as Proof of Having a Visa.
Additional Information Immigration and Ministry of Manpower:
A. Immigrations
1. Extension of VOA (Visa On Arrival), ITK (Visit Visa), Kitas/Itas, Itap/Kitap and Multiple Exit Re-entry Permit (MERP) can be processed already;
2. Mutation address and passport foreigner services can be processed already;
3. EPO and ERP (Exit Permit) can be processed already;
4. Visa Approval/Telex application services have not open yet been for foreigners;
5. Visa holders such as the Visit Visa index D212, B211A, B211B, B211C and B213/Work Visa index 312/Investor Visa index 313 and 314 or ABTC (Apec Business Travel Card) who are still abroad, still unable to enter to Indonesian territory. (Except for the 7 exceptions listed in the Ministry of Law and Human Rights Regulation No. 11 of 2020);
6. Holders of Visa Approval/Telex are still unable to obtain visas at the Embassy/Consulate. The Embassy/Consulate only serving foreigners who working on national strategic projects (in accordance with Ministry of Law andHuman Rights Regulation No. 11 of 2020), but to make sure, regarding the embassy that is already open, please coordinate with the embassy concerned to avoid mistakes in providing information;
B. Ministry of Manpower
1. The application for a new applicant’s work permit cannot be processed based on a circular from the Ministry of Manpower No. M/4/HK.04/IV/2020 and Regulation of the Ministry of Law and Human Rights No. 11 year 2020 concerning Temporary Prohibitions of Entry (Travel Ban) into Indonesia for Foreigners in response to Covid-19’s Outbreak. Except those who have a Recommendation Letter from BKPM. (Foreign Companies (PMA) which will plan to bring in its company representatives and or expert foreign workers (TKA) outside the Ministry of Law and Human Rights Regulation No. 11 of 2020).
2. The Ministry of Manpower has reopened the services extension of work permit to foreign workers who will extend their Limited Stay Permits.
