Definition of foreign investment companies (PMA)

Are individual Business Actors of foreign nationality, foreign business entities, and/or foreign governments conducting Investments in the territory of the Republic of Indonesia.

Definition of investment facility

Are all forms of fiscal and non-fiscal incentives as well as ease of Investment services, in accordance with the provisions of laws and regulations.

Recommendations available at BKPM or now better known as the Ministry of Investment, are in the form of:

a. Recommendation to convert the status of a visit stay permit (ITK) into a limited stay permit (KITAS)

Recommendations for conversion the status of a visit stay permit (ITK) to a limited stay permit (KITAS), are given to:
a. foreigners as shareholders who serve as directors or commissioners of the company; and
b. foreigners as shareholders who do not serve as directors or commissioners of the company.

b. Recommendation to convert the status of a limited stay permit (KITAS) into a permanent stay permit (KITAP)

Recommendation of conversion the status of a limited stay permit (KITAS) to permanent stay permit (KITAP) are given to:
a. foreigners as shareholders who serve as directors or commissioners of the company; and
b. foreigners as shareholders who do not serve as directors or commissioners of the company.

Criteria foreigners who can submit a letter of recommendation for conversion status stay permit

a. as a shareholder and serving as a director or commissioner of the company with the provision that share ownership is at least IDR 1,000,000,000.00 (one billion Rupiah) or the equivalent in United States dollars stated in the deed; or

b. as a shareholder and not as a director or commissioner of a company with the provision that share ownership is at least IDR 1,125,000,000.00 (one billion one hundred twenty five million Rupiah) or the equivalent in United States dollars stated in the deed.

Requirements for submitting a recommendation letter for conversion status

Submit Kitap

Visit Stay Permit (ITK) to Limited Stay Permit (KITAS)

1. Copy of identity of person in charge/company guarantor:

a. The directors/commissioners:
>  Foreigner: passport, valid stay permit & NPWP.
>  Indonesian citizens: KTP & NPWP.

b. Personnel Manager (must be an Indonesian citizen):
>  KTP, NPWP, and Letter of Appointment as Manager Personnel (HR)

2. Copy of Visit Stay Permit (ITK) and passport of a foreigner as a shareholder whose status of stay permit want changed.

3. Power of Attorney:

a. Signing of the Application if the application is not carried out by the person in charge of the company.
b. Management of Applications if the submission of applications is not carried out directly by the person in charge of the company.

4. Copy of company documents (Deed, Decree of the Ministry of Law and Human Rights – Establishment and amendment, if any, as well as NPWP and licenses owned by the company.

5. Application letter to the Ministry of Investment / BKPM.

Limited Stay Permit (KITAS) to Permanent Stay Permit (KITAP)

1. Copy of identity of person in charge/company guarantor:

a. The directors/commissioners:
>  Foreigner: passport, valid residence permit & NPWP.

b  Personnel Manager – HR (must be Indonesian citizen):
>  KTP, NPWP, and Letter of Appointment as Manager Personnel – HR

2. Copy of KITAS for the last 3 years, NPWP, and passport of a foreigner as a shareholder who wants to convert his residence permit status.

3. Power of Attorney:

a. Signing of the Application if the application is not carried out by the person in charge of the company.
b. Application Management if the application is not carried out directly by the person in charge.

4. Copy of company documents (Deed, Decree of the Ministry of Law and Human Rights – Establishment and amendment, if any, as well as NPWP and licenses owned by the company.

5. Application letter to the Ministry of Investment / BKPM.
